Maryland SB1- Retail Energy Reform- 2024- Tasks Needed to Complete to Execute the law. 

  1. The Commission shall require a residential energy retailer to post on the retailer’s website, in clear and unambiguous language: (1) the terms and conditions of the residential services and products sold by the retailer; and (2) an environmental disclosure, in a format required by the Commission, for the residential services and products sold by the retailer.

  2. Beginning July 1, 2025, a person may not engage in the business of an energy salesperson or energy vendor in the state unless the person holds a license issued by the commission.

  3. The term of a residential electricity and gas supplier license is 3 years.

  4. An electric cooperative may advertise, market, and promote standard offer service and related products in its service territory.

  5. A supplier may offer electricity, other than green power, only at a price that does not exceed the trailing 12–month average of the electric company’s standard offer service rate in the electric company’s service territory.

  6. A supplier may offer residential electricity / gas supply only: 1. for a term not to exceed 12 months at a time 2. for electricity supply other than green power, may automatically renew the term only if the electricity supplier provides notice to the customer 90 days before and 30 days before renewal; 3. may offer green power that meets the requirements of 7–707 but may not automatically renew the term with the customer; 4. may not offer a variable rate other than a rate that adjusts for seasonal variation not more than twice in a single year (all rules apply to gas suppliers as stated in bill).

  7. A supplier may not pay a commission or other incentive–based compensation to an energy salesperson for enrolling customers

  8. A residential electricity / gas supplier may not sell to an electric company, and an electric company may not purchase from an the electricity supplier, accounts receivable.

  9. A supplier and electric / gas company must establish process to provide a new customer choice ID if it's been compromised.

  10. A supplier and electric / gas company must establish process to establish a "Do Not Transfer" list.

  11. On or before the 15th day of each month, each billing entity shall submit a report to the Commission certain data on customer choice in its service territory for the preceding month.

  12. Expansion of data that must be supplied by retailer to RPS report to include more information on sources of RECs.

  13. An electricity supplier that supplies electricity to residential retail electric customers may not market electricity as green power unless it meets certain requirements.

  14. The Commission shall establish a division within the Commission with the specific responsibility to receive, investigate, and resolve, including by disciplinary actions and prosecution, complaints against electricity suppliers, gas suppliers, and energy salespersons for violations with respect to retail customers;The Commission may impose up to $275,000 as a special assessment provided that electricity suppliers, gas companies, and gas suppliers otherwise subject to the yearly assessment provided that the assessment shall be imposed only on those electric companies, electricity suppliers, gas companies, and gas suppliers otherwise subject to the assessment.

  15. The licenses of electricity suppliers and gas suppliers that are licensed by the Public Service Commission as of July 1, 2024, shall expire on a staggered basis as determined by the Commission, such that equal numbers of licenses shall expire throughout each of the following 3 years but not later than June 30, 2027.

  16. On or before December 31, 2024, the Public Service Commission shall develop a training and education program for any entity or individual that is licensed by the Commission as an electricity supplier, a gas supplier, an energy salesperson, or an energy vendor; and report to the General Assembly on the status of the development of the training and education program.

  17. The Commission shall study and make recommendations to EEE and ECM by December 15, 2024on issues related to the utilization of end–use electricity customer load that is physically connected to the facilities of an existing or planned electric generation facility, also known as co–located load configuration

  18. Green power rules:

    1. The Commission approves the price of the electricity being marketed as green power in accordance with procedure established the Commission.

    2. The Commission may set a price per megawatt–hour that is higher than the price determined in the proceeding held, for an electricity supplier under certain circumstances.

    3. A price approved by the Commission may not exceed 150% of the maximum price per megawatt–hour unless under certain circumstances.

    4. Within 120 days after approving a price for green power that exceeds 150% of the maximum price per megawatt–hour that is authorized, and annually for as long as the price exceeds that amount, the commission shall submit a report to the General Assembly with certain information.

    5. An electricity supplier that claims in the electricity supplier’s marketing of electricity to residential retail electric customers that the customer will be purchasing green power shall include a certain or similar disclosure as approved by the Commission.

    6. In addition to the disclosure required the Commission shall adopt regulations that require an electricity supplier that offers green power for sale to residential retail customers to include in the electricity supplier’s marketing materials a disclosure, written in plain language, that explains certain items.
